Rules and Regulations

Cancellation Policy

All prices are in US dollars and we require a 50% deposit to reserve your stay dates.

The deposit is 100% refundable if needing to cancel up to 60 days before arrival and non – refundable.

Once we receive your 50% deposit your stay is confirmed.

Full payment is due at least 60 days prior to check in date.

Welcome to Viva Condominiums Unit 7, this gated 48-unit private community is where paradise meets relaxation in the heart of San Jose del Cabo. Please read and follow our Rules and Regulations to make Viva an enjoyable place for all.

These rules are meant to respect your comfort, enjoyment, and safety while staying at Viva.

If you see any breach of any of these rules, do not confront but rather notify the Viva office manager. Viva Office Manager is the person to ensure that all rules are maintained and respected.

Any rules that are marked with “*** asterisk” are subject to one warning to the Owner/Occupant of unit, after which fines of $50usd will be levied for each infraction on the Owner of the unit and added onto year end HOA Dues.

  • *** Quiet hours are to be observed from 10:00pm until 8:00am.
  • *** Viva is a non-smoking, non-vaping facility.  Smoking/vaping must be outside of the entry gate or beyond the roped area on the beach.
  • *** No pets are allowed and do not feed outside animals or encourage them to be on the property.
  • Owners may only bring 1 personal Food Smoker/BBQ to BBQ area and these must be removed from the BBQ area when not in use.  No placement of Food Smokers/BBQ’s are permitted on any pool deck furniture. Absolutely no personal Smokers/BBQ’s are allowed to be used or stored on private condominium patios or common property.
  • Use only liquid detergent in laundry washing machines.
  • Do not hang towels or clothing from balconies or patios where they are visable.
  • Park only in the stall assigned to your unit. If your unit has a garage then extra vehicles must be parked outside the gate unless you have permission to park in another unit’s stall.
  • Be mindful to keep larger objects out of the sewer system such as wipes, feminine hygiene products or excess toilet paper.
  • The common areas including the pool, laundry room and tennis courts are for owners and residential guests. You must accompany your outside visitors while they are on the property. Visitors may use the tennis/pickleball courts with their hosts after the noon hour or when the court is unoccupied.
  • In the pool area breakable dishes, bottles or glassware are not allowed.
  • There is no lifeguard on duty. Owners and guests use the pool and Common Areas at their own risk. Children under 12 must be accompanied by an adult. No jumping or diving into the pool is allowed.
  • Be mindful of pool etiquette. Headphones must be used with all personal electronic devices. Saving pool chairs is not permitted. Do not leave unattended towels on chairs for more than 60 minutes.
  • Special events such as live music, dancing or celebrations must be approved by the Viva Office Manager with at least 24-hours notice. The Office Manager can approve ongoing weekly events as well, and will notify Owners (who will notify their guests) of approved events.   • Special Events are not to restrict the use of the Common Areas or BBQ’s (3) for any other Owners or Guest

Informational Materials / Non-Rules

    • Notify your owner or property manager if services, cleaning, repairs or maintenance is required in your unit.  A list of manager names and numbers is posted on the office window/laundry room.
    • Notify the Viva Office Manager if you see problems in the common area. The Viva HOA is responsible for all grounds and common areas.
    • Laundry tokens are available for purchase in the office.
    • BBQs (3) for use by Owners and Guests are located in the pool area.
    • Conserve water as you are able we are in a dessert.
